The mandate of the existing Multi-modal Transportation of Goods Act, 1993 is for registration of MTOs. The said act neither mandates resolution of dispute of shipping lines/CFS/Customs with their customers nor regulation of the price charged by the Shipping lines/CFS/Customs from its customers.

It is suggested that such disputes should be taken up with the respective custom authorities. However, the DGS issued advisory vide DGS Circular No. 01 of 2016 dated 07.09.2016 followed by clarification dated 26.12.2016 identifying the conditions for levy of certain charges and advising the stakeholders that no new charges should be levied and the charges held as not available in the advisory should not be re-introduced with a different nomenclature. The office of Commissioner of Customs, JNCH has issued Public Notice (No. 158 of 2016) to Shipping Lines /Shipping Agents etc. under the provisions of Handling of Cargo in Customs Areas Regulation, 2009, making compliance of the above said DGS advisory mandatory. The said Public Notice has also clearly mentioned that any non-compliance by any shipping lines should be brought to the knowledge of ADC (PG), who will ensure that suitable action is initiated against the defaulters. Further, the said advisories were again reiterated vide DGS Circular No. 26/2021 dated 14.09.2021 advising Shipping Lines, Freight Forwarders, NVOCCs, MTOs, and CHAs operating in India not to levy any additional charges.
